17. Arbitration Provision, Waiver Of Class Action, And Choice Of Law

Any dispute, claim, or controversy arising out of or relating to the use of this website, its services, these terms of use, Jampack Trips, products, bookings, reservations (including but not limited to those made online), policies (including privacy policy), terms and conditions (hereinafter referred to as "Dispute") shall be resolved by binding arbitration. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) then in effect, except as modified by this agreement. The arbitration shall be conducted by a single arbitrator selected in accordance with AAA rules. The arbitration shall take place in Las Vegas, Nevada, USA and the language of the arbitration shall be English. The laws of the State of Nevada, USA, shall govern the interpretation and enforcement of this arbitration provision. Any arbitration under these terms will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted.

BY MAKING YOUR PURCHASE, YOU AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

18. User-generated content

These Terms ("Agreement") apply to our use of any words, pictures, video, images, data, information, or any other 'user-generated content' ("Content") that a user uploads, posts, or shares using third party websites or social media platforms, including but not limited to Instagram, Facebook, Pinterest, YouTube and Twitter.

19. Our right to use the Content

By submitting, posting, or displaying Content you are granting us a perpetual, worldwide, non-exclusive, fully paid-up, fully transferable right and license to use such Content in all forms and media.

20. Miscellaneous

  1. If one or more of the provisions contained in the Agreement is found to be invalid, illegal, or unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions shall not be affected.
